ALGORITHM OF INTERACTION

PJSC «MMC «NORILSK NICKEL» WITH INDIGENOUS SMALL-NUMBERED AND REINDEER-HERDING PEOPLES OF MURMANSK REGION ON THE PROJECT OF THE KOLMOZERSKOYE LITHIUM DEPOSIT

CONSULTATIONS
Consultation Parties: PJSC «MMC «Norilsk Nickel» and indigenous small-numbered and reindeer-herding peoples of Murmansk region.

All parties are required to:
  • Willingness to participate in the process and to meet within a reasonable time and at reasonable intervals;

  • Provision of information necessary for informed negotiation;
  • Examination of key important issues;
  • Use of mutually acceptable negotiation procedures;
  • Readiness to modify, if necessary, its initial position and proposal;
  • Adequate time for decision-making.
  • The parties shall strive to find accessible solutions to their differences, shall focus on establishing mutual respect and eliminating any imbalance of power.
  • Forms of consultations: gatherings, individual and group consultations, meetings with the working group.

Meeting of the working group of indigenous small-numbered and reindeer-herding peoples of the Murmansk region on the project of the Kolmozerskoye deposit and representatives of PJSC «MMC «Norilsk Nickel».
The aim of the working group is the inclusive participation of representatives of indigenous small-numbered and reindeer-herding peoples of the Murmansk region in the due diligence activities of the Kolmozerskoye project, including in conducting ethnological expertise studies, in order to take into account the opinion and verify the results at all stages of the research.

The working group is composed of representatives of the following organizations:
  • Public Organization of the Murmansk Region «Association of Kola Saami»;
  • Public Organization for the promotion of legal education and preservation of the cultural heritage of the Saami of the Murmansk Region;

  • Agricultural production cooperative reindeer herding farm of Indigenous Peoples of the North «TUNDRA»;
  • Agricultural production cooperative reindeer herding farm of small-numbered peoples of the North «OLENEVOD»;
  • Council of representatives of the indigenous small-numbered Saami people under the government of the Murmansk Region.

is to inform on time about the planned project, discussion of possible algorithms of interaction with indigenous small-numbered and reindeer-herding peoples of Murmansk region in order to minimize the negative impact of the project on the traditional way of life, crafts and culture.

      • A set of measures to avoid, minimize and mitigate potential adverse impacts on affected indigenous communities, communities and social groups.
      • A proportionate and fair compensation package.
      • Includes mechanisms to support socio-economic development, quality of life and well-being of the affected indigenous communities. This may include support for a clean environment, traditional occupations and industries, employment and business of indigenous peoples, conservation and rehabilitation of reindeer husbandry, language and culture, educational and capacity-building programmes for indigenous peoples.
      • It is part of the Agreement on Free, Prior and Informed Consent.
      FREE, PRIOR AND INFORMED CONSENT (FPIC)
      • Mechanism for the realization of the right of indigenous peoples to participate in decision-making in matters affecting them.
      • Free - Indigenous peoples make their own decisions according to their own procedures and taking into account the views of vulnerable communities.
      • Prior- consultations take place in advance.
      • Informed - the company provides complete, reliable and accessible information about the project on the basis of which indigenous peoples make their decision.
      • Consent - in the case of consent, an agreement on consent is signed, specifying the conditions of its giving. The Indigenous Peoples Plan is part of such an agreement.

      • Appeals from individuals, organizations, communities and institutions representing the indigenous small-numbered and reindeer-herding peoples of the Murmansk region, potentially or actually affected by the Kolmozerskoye lithium deposit
      • Other stakeholders involved in the Company’s consultations with indigenous small-numbered and reindeer-herding peoples on the Kolmozerskoye lithium deposit
      • Appeals should be related to the Kolmozerskoye lithium deposit rather than to the Company’s operations as a whole

      • Appeals concerning violations by the Company, its employees, contractors or subcontractors of the collective or individual rights of indigenous peoples, international standards, ethical norms, corporate policies of the Company, agreements reached and decisions taken regarding the Kolmozerskoye lithium deposit.
